Terms & Conditions
Article 1: General
1.1 In these General Terms and Conditions, the following terms shall have the meanings ascribed to them: 'CyraJewel' or 'CyraJewel.nl Internet Shop': CyraJewel; customer: the (potential) customer of goods and/or services from CyraJewel; 'confirmation': the receipt confirmation, as described in articles 2.2 and 3.1. 'General Terms and Conditions': these General Terms and Conditions.
1.2 These General Terms and Conditions apply to all offers, orders, and agreements of CyraJewel. By the conclusion of an agreement between the customer and CyraJewel through the procedure described in these General Terms and Conditions, the customer expressly accepts these conditions.
1.3 All rights and claims, as stipulated in these General Terms and Conditions, and in any further agreements concluded for the benefit of CyraJewel, are equally stipulated for the benefit of intermediaries and other third parties engaged by CyraJewel.
1.4 Deviations from these General Terms and Conditions are only valid if expressly agreed upon in writing with CyraJewel.
1.5 If any provision(s) of these General Terms and Conditions are void or annulled, the remaining provisions of these General Terms and Conditions shall remain in full force. CyraJewel and the customer shall then consult in order to agree on new provision(s) to replace the void or annulled provision(s), while taking into account the objective and purpose of the void or annulled provision(s) as much as possible.
1.6 CyraJewel reserves the right to amend these General Terms and Conditions and the content of the CyraJewel website at any time.
Article 2: Offers & Agreements
2.1 All offers made on the CyraJewel website are without obligation, even if they contain a period of acceptance. CyraJewel reserves the right to withdraw offers at any time. All offers are subject to availability. Price changes are reserved at all times.
2.2 An agreement between CyraJewel and the customer is concluded after the customer:
has placed an order on the CyraJewel website, by fully and correctly completing the order form on the CyraJewel website;
then clicking on the 'Checkout' icon on the CyraJewel website;
subsequently confirming that the information provided by the customer is correct and processing the customer's payment, by clicking on the 'Send order' icon on the CyraJewel website,
upon which CyraJewel has received a confirmation from CyraJewel at the customer's email address that CyraJewel has received the customer's order (the receipt confirmation).
2.3 The agreement contains all agreements made between the customer and CyraJewel and replaces all previous agreements, arrangements, and/or agreements made between the customer and CyraJewel.
2.4 CyraJewel's administration shall, unless proven otherwise, serve as evidence of the orders given by the customer to CyraJewel and the payments made by the customer, and of the deliveries made by CyraJewel. CyraJewel acknowledges that electronic communication can serve as evidence. By accepting the General Terms and Conditions, the customer also acknowledges this.
2.5 The receipt confirmation shall at least mention the following information:
a description of the product purchased by the customer and the number of products purchased by the customer;
the price of the product;
customer details such as name, customer number, residential address, address to which the product is to be sent, billing address (if different from the customer's residential address and/or delivery address), and email address and telephone number of the customer;
the order number of the agreement;
the email address and/or telephone number of CyraJewel, where the customer can inquire about the order.
Article 3: Prices & Payment
3.1 All prices for the goods offered are in Euros and inclusive of value-added tax (VAT) and other levies imposed by the government, and exclusive of handling and shipping costs, unless otherwise stated or agreed in writing.
3.2 All invoices shall be paid by the customer, without deduction or compensation, within 7 working days after the invoice date, unless otherwise agreed in writing.
3.3 In case the payment term is exceeded, CyraJewel is entitled to charge the customer interest from the due date of the invoice, with a part of a month being counted as a whole month. CyraJewel will send a reminder in case of exceeding the payment term.
3.4 If, even after sending the reminder, the customer has not paid, not fully paid, or not paid by the deadline set in the reminder, CyraJewel has the right to charge the customer extrajudicial (collection) costs. The customer is also obliged to pay the actual legal costs incurred, to the extent that any court costs order results in a lower amount.
3.5 In case of non-compliance by the customer with the agreed payment terms, CyraJewel is entitled to immediately extrajudicially terminate the agreement or suspend its obligations, and is also entitled to refuse the customer access to CyraJewel's system without stating reasons.
Article 4: Deliveries
4.1 Deliveries are made exclusively within the Netherlands and Belgium, unless otherwise indicated on the CyraJewel website.
4.2 The delivery time is normally up to 15 working days, unless otherwise indicated on the CyraJewel website. Delivery times are indicative and not strict deadlines.
4.3 The delivery period of the product is a maximum of 30 working days or shorter as stipulated in the agreement between the customer and CyraJewel.
4.4 If, for any reason, the agreed delivery period is exceeded by CyraJewel, CyraJewel shall immediately notify the customer thereof in writing (via email). In this case, the customer has the right to terminate the agreement with CyraJewel by notifying CyraJewel of this in writing (via email).
4.5 Any payments already made by the customer will be refunded as soon as possible, but in any case within 14 working days after CyraJewel has received the customer's request for termination of the agreement as mentioned in article 4.4.
4.6 The delivery times specified by CyraJewel shall never be considered as strict deadlines, unless expressly agreed otherwise.
4.7 Delivery shall take place at the place and time the goods are ready for dispatch to the customer.
4.8 CyraJewel reserves the right to make partial deliveries to the customer, so that an order is shipped in two or more shipments.
Article 5: Force Majeure and/or Special Circumstances
5.1 CyraJewel shall not be obliged to fulfill any obligation towards the customer if it is prevented from doing so as a result of a circumstance not attributable to its fault, nor for which it is liable under the law, legal act, or generally accepted practices.
5.2 Circumstances within the meaning of article 5.1 include, among others, a business interruption, a disruption in the supply of energy or materials, transport delays, a strike, and non or untimely delivery by suppliers.
Article 6: Retention of Title
6.1 All goods delivered to the customer remain the property of CyraJewel until all amounts owed by the customer for the goods delivered under the agreement have been fully paid to CyraJewel.
Article 7: Risk
7.1 The risk during the transport of the product ordered by the customer is borne by CyraJewel. At the moment of delivery of the product, or the moment that can reasonably be considered as delivery, the risk of the product passes to the customer, except for the liabilities that cannot be excluded by law.
Article 8: Intellectual and Industrial Property Rights
8.1 The customer shall fully and unconditionally respect all intellectual and industrial property rights resting on the goods delivered by CyraJewel.
8.2 CyraJewel does not guarantee that the goods delivered to the customer do not infringe any intellectual and/or industrial property rights of third parties, and accepts no liability in case of any claim by third parties based on the assertion that a good delivered by CyraJewel infringes any right of a third party.
Article 9: Orders/Communication
9.1 CyraJewel is in no way liable for misunderstandings, damages, delays, or unclear communication of orders and communications as a result of the use of the internet or any other means of communication in the traffic between the customer and CyraJewel, or between CyraJewel and third parties, insofar as they concern the relationship between the customer and CyraJewel.
Article 10: Cooling-off Period
10.1 After the customer has received the ordered product, the customer has the right to terminate the underlying agreement with CyraJewel within 14 days of receiving the product, without stating a reason.
10.2 If the customer wishes to terminate the agreement pursuant to article 10.1 of these terms and conditions, the customer must notify CyraJewel of this in writing (via email). In this case, the customer must, after consultation with CyraJewel, send the product to a return address determined by CyraJewel. In this case, the customer must bear the costs and risk of the shipment.
10.3 If the customer has already made any payments at the time the customer has terminated the agreement with CyraJewel pursuant to articles 10.1 and 10.2 of these General Terms and Conditions, CyraJewel will refund these payments to the customer within 10 working days after CyraJewel has received the product returned by the customer.
10.4 CyraJewel reserves the right to refuse returned products or to credit only a part of the amount already paid if there is reason to suspect that the product has already been opened, used, or damaged by the customer (other than by CyraJewel or the supplier of the product).
10.5 If a product is returned which, in the opinion of CyraJewel, has suffered damage due to an act or omission of the customer or otherwise is at the customer's risk, CyraJewel will inform the customer thereof in writing (via email). CyraJewel has the right to deduct the depreciation of the product due to this damage from the amount to be refunded to the customer.
Article 11: Guarantees
There is a warranty on the products delivered by CyraJewel. This is the warranty as determined by the manufacturer on its products. This warranty does not affect the customer's rights arising from the law.
Article 12: Complaints Procedure
12.1 All complaints regarding delivery, quality, condition of the product, or any other complaint, will be dealt with seriously by CyraJewel.
12.2 The customer must report a complaint to CyraJewel via the contact form.
12.3 CyraJewel will attempt to resolve the complaint within 10 working days. CyraJewel will inform the customer about this in writing (via email).
Article 13: Personal Data
13.1 Personal data entered by the customer will be included in a file. These data will be used for the execution of the customer's order.
13.2 Unless the customer has indicated otherwise, the customer's data will be included in a central file of CyraJewel. These data will be used to keep the customer fully up-to-date regarding the goods and services of CyraJewel. The processing of the customer's data shall be carried out in accordance with applicable laws and regulations.
13.3 The customer may request access to the data recorded by CyraJewel about the customer in CyraJewel's file. The customer is entitled to request a change in the data if the data is incorrect.
Article 14: Disputes
14.1 Only Dutch law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply.
